Ownership and Rights 
of Commissioned Art

When commissioning a custom artwork from Sharon Comello Art, it’s important to understand the ownership 
of the intellectual property.

Physical Ownership:

You will own the physical artwork upon delivery, but Sharon retains the copyright unless otherwise agreed. This means Sharon holds the exclusive rights to reproduce, sell prints, or display the artwork in promotional materials, exhibitions, or online portfolios.

Licence for Personal Use:

As the commissioner, you are granted a non-commercial licence to display the artwork in your home or office, and to share it privately. If you wish to use the artwork for commercial purposes (such as reproducing it on merchandise or using it in advertising), you will need to negotiate a separate agreement for the transfer of copyright or additional licensing.

Commercial Use and Buy-Out Option:

If you would like full ownership of the artwork’s rights, including reproduction and commercial use, a copyright transfer can be arranged for an additional fee. This would allow you to use the artwork without restrictions.
